Legal Requirements for Marriage in Australia

If you wish to marry in Australia:

  1. You must be 18 years of age or over;
  2. You are required to lodge a Notice of Intended Marriage (Form 13) with an authorised celebrant no later than 1 month prior to your planned wedding date. This form is valid for 18 months from date of lodgement. This form is provided by celebrant or can be downloaded from Attorney-General’s Department;
  3. Relevant ID documentation to be sighted by celebrant prior to marriage:
    1. If Australian born you will need to produce your original birth certificate (preferable) or passport (current);
    2. If born overseas you will need to produce either your original birth certificate or overseas passport (current);
    3. If born overseas and have been granted Australian citizenship and your overseas passport has been "replaced" by an Australian one you should produce the Certificate of Citizenship, Australian passport and "replaced" overseas passport.
    4. Photo ID e.g. driver’s licence.
  4. If you have been married previously you would need to produce the relevant Divorce or Death Certificate;
  5. You must complete a Form 14 Declaration prior to marriage confirming there is no legal impediment to your marriage - this is provided by celebrant.
